DECISION No.558/QD-TTg of July 4, 1998 recognizing Quy Nhon as a grade II-city.

DECISION No.113/1998/QD-TTg OF JULY 6, 1998 ON TRANSFORMING THE NORTHERN, MIDDLE AND SOUTHERN AIRPORTS AND AIR-FIELDS AUTHORITIES INTO STATE PUBLIC-UTILITY ENTERPRISES

Pursuant to the Law on Organization of the Government of September 30, 1992;

Pursuant to the Law on State Enterprises of April 20, 1995;

Pursuant to Decree No.56-CP of October 2, 1996 of the Prime Minister on the State public-utility enterprises;

At the proposal of the Director of the Civil Aviation Administration of Vietnam,

DECIDES:

Article 1.- To transform the Northern Airports and Airfields Authority, the Middle Airports and Airfields Authority and the Southern Airports and Airfields Authority from non-business units having revenues into State public-utility enterprises attached to the Civil Aviation Administration of Vietnam and rename them as the Northern Airports Authority, the Middle Airports Authority and the Southern Airports Authority (hereafter referred to as regional airports authorities).

Article 2.- The regional airports authorities have the legal person status, their own seals and bank accounts, the civil rights and obligations as provided for by law; and take responsibility for their business activities within the amount of capital under their management.

The Northern Airports Authority, or NAA in abbre-viation, is the international transaction name of the airports authority of the northern region; its head office is located at the Noi Bai International Airport, Hanoi city; its statutory capital at the time of being transformed into a State enterprise is VND 520,077 million.

The Middle Airports Authority, or MAA in abbreviation, is the international transaction name of the airports authority of the middle region; its head office is located at the Da Nang International Airport, Da Nang city; its statutory capital at the time of being transformed into a State enterprise is VND 509,259 million.

The Southern Airports Authority, or SAA in abbreviation, is the international transaction name of the airports authority of the southern region, its head office is located at the Tan Son Nhat International Airport, Ho Chi Minh City; its statutory capital at the time of being transformed into a State enterprise is VND 522,652 million.

Article 3.- The regional airports authorities shall have the following main tasks:

1. To manage and exploit the regional airports, provide aviation services and other public services in order to ensure the safety and efficiency of the flights conducted by various airlines;

2. To be authorized by the Director of the Civil Aviation Administration of Vietnam to perform a number of State management tasks directly associated with the administration activities at the airports;

3. To preserve, develop and efficiently use the capital, land and other resources assigned by the State in conformity with the State's laws and policies;

4. To organize and manage the research and application of scientific and technological advances, and the training and fostering of officials and employees of the regional airports authorities.

Article 4.- The Director of the Civil Aviation Administration of Vietnam shall propose to the Prime Minister for promulgation the Regulation on coordination between the regional airports authorities and the defense sector and concerned branches; base himself/herself on the Law on State enterprises and the current regulations to approve the Charter on organization and operation of regional airports authorities, appoint directors, deputy directors and chief accountants of the regional airports authorities and direct the carrying out of the subsequent procedures as prescribed in Decree No.50-CP of August 28, 1996 of the Government on the establishment, reorganization and bankruptcy of State enterprises.

Article 5.- This Decision takes effect after its signing. The previous stipulations which are contrary to this Decision are now annulled.

The ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government, the presidents of the People's Committees of the provinces and cities directly under the Central Government, the Director of the Civil Aviation Administration of Vietnam shall have to implement this Decision.
