DECISION
Promulgating a list of articles subject to plant quarantine and pest risk analysis before they are imported into Vietnam
THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to the Government's Decree No. 86/2003/ND-CP of July 18, 2003, defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the 2001 Ordinance on Plant Protection and Quarantine;
Pursuant to the Government's Decree No. 02/2007/ND-CP of January 5, 2007, on plant quarantine;
At the proposal of the Director of Plant Protection Department,
DECIDES:
Article 1.- To promulgate a list of articles subject to plant quarantine and pest risk analysis before they are imported into Vietnam, including:
1. Plants and plant products
a/ Plant varieties and breeding materials;
b/ Fresh fruits.
2. Living organisms in the plant protection field
a/ Biological prevention agents.
b/ Other living organisms.
3. Other articles at high risk of carrying harmful organisms shall be determined and added in each period.
Article 2.- The above-mentioned articles, when imported, may only be subject to pest risk analysis or reconsideration of the result of earlier pest risk analyses if they fall in one of following cases:
1. Being imported into Vietnam for the first time;
2. Being of a new origin;
3. There are factual and scientific evidences on the outbreak of an epidemic subject to Vietnam's regulation on articles in the exporting country;
4. A pest subject to regulation is detected.
Article 3.- This Decision takes effect 15 days after its publication in "CONG BAO." In each period, this Decision shall be amended or supplemented to suit the actual situation of the import of articles subject to plant quarantine;
Article 4.- The director of the Ministry's Office, the director of the Plant Protection Department, heads of relevant organizations, and concerned individuals shall implement this Decision.
