DECISION No.568-QD/QLCN OF MAY 16, 1997 ISSUING THE REGULATION ON ORGANIZATION AND MODE OF OPERATION OF THE NATIONAL INTERNET COORDINATION COMMITTEE IN VIETNAM
THE MINISTER OF SCIENCE, TECHNOLOGY AND ENVIRONMENT
Pursuant to the Decree No.22-CP of May 22, 1993 of the Government stipulating the tasks, powers and organizational structure of the Ministry of Science, Technology and Environment;
Pursuant to Decree No.21-CP of March 5, 1997 of the Government promulgating the Provisional Regulation on the Management, Establishment and Use of the INTERNET network, Decision No.136-TTg of March 5, 1997 of the Prime Minister on the establishment of the National Internet Coordination Committee in Vietnam and Decision No.300-TTg of May 8, 1997 of the Prime Minister on the appointment of members of the National Internet Coordination Committee;
At the proposal of the members of the National Internet Coordination Committee at its meeting on May 3, 1997;
At the proposal of the Director of the Technology Management Department,
DECIDES:
Article 1.- To issue together with this Decision the Regulation on Organization and Mode of Operation of the National Internet Coordination Committee.
Article 2.- This Decision takes effect upon its signing.
Article 3.- The ministries, branches and localities, agencies and individuals who are members of Vietnam�s National Internet Coordination Committee, the Director of the Technology Management Department, the Head of the Office of the Ministry of Science, Technology and Environment shall have to implement this Decision.

REGULATION ON ORGANIZATION AND MODE OF OPERATION OF VIETNAM�S NATIONAL INTERNET COORDINATION COMMITTEE
Chapter I
THE FUNCTIONS, TASKS, ORGANIZATION AND POWERS OF THE NATIONAL INTERNET COORDINATION COMMITTEE IN VIETNAM
Article 1.- Vietnam�s National Internet Coordination Committee, established by Decision No.136-TTg of March 5, 1997 of the Prime Minister (hereafter referred to as the Coordination Committee for short), shall have the following functions and tasks:
1. To direct the coordination of activities among ministries, branches and localities in the establishment, management and expansion of the Internet network and services in Vietnam.
2. To direct the formation and evaluation of projects concerning the policy, planning and plans for the development of the network, technical and technological solutions, to ensure the safety and confidentiality of information exchanged on the network.
3. To direct the supervision of observance of the State�s regulations on management of the operation of the Internet.
Article 2.- The organization and personnel of the Coordination Committee, the Standing Body of the Coordination Committee and the Technical Consultation Council of the Coordination Committee.
Under Decision No.136-TTg of March 5, 1997 of the Prime Minister, the Coordination Committee is composed of:
The Minister of Science, Technology and Environment as its Chairman.
The General Director of the General Department of Post and Telecommunications as its Vice Chairman.
Its members include leading officials of the Ministry of Culture and Information, the Ministry of the Interior, the Ministry of Education and Training, the Ministry of Science, Technology and Environment, the National Center for Natural Sciences and Technology and the Steering Committee for the National Program for Information Technology.
The members of the Coordination Committee shall be appointed by decision of the Prime Minister on the basis of recommendations of the leading officials of the above-said member agencies, and at the proposal of the Minister of Science, Technology and Environment.
The National Internet Coordination Committee in Vietnam shall have as its Standing Body and Technical Consultation Council:
- The Standing Body of the Coordination Committee is the Ministry of Science, Technology and Environment. The organization and operation of the Standing Body shall be decided by the Minister of Science, Technology and Environment.
- The Technical Consultation Council of the Coordination Committee shall be set up by decision of the Chairman of the Coordination Committee and composed of a number of scientists, technocrats and specialists in the management of the Internet network. The Council is assigned to provide the Coordination Committee with consultancy on the relevant technical matters.
Article 3.- The duties and powers of the members of the Coordination Committee:
1. The Chairman shall have the following tasks:
- To lead the Coordination Committee in properly performing its tasks as prescribed in Article 1, Chapter 1 of this Regulation and the tasks prescribed in the Provisional Regulation on the management, establishment and use of the Internet network in Vietnam, issued together with Decree No.21-CP of March 5, 1997 of the Government.
- To convene and chair meetings of the Coordination Committee.
- To prepare the agenda of issues to be discussed at the meetings of the Coordination Committee, to synthesize and handle petitions of the Coordination Committee.
- To summarize facts and make and submit reports to the Prime Minister, according to the function and tasks of the Coordination Committee.
2. The Vice Chairman shall have the following tasks:
- To assist the Chairman in running the activities of the Coordination Committee and be responsible to the Chairman for his/her assigned tasks.
- To handle, on behalf of the Chairman of the Coordination Committee, all work of the Committee which falls within the power of the Chairman when the latter is absent.
3. The members of the Coordination Committee shall have the following duties and powers:
- To represent and be responsible to leading officials of their respective ministries or branches for participating in all activities necessary to properly perform the functions and tasks of the Coordination Committee as prescribed in Article 1, Chapter I of this Regulation, the tasks prescribed in the Provisional Regulation on the management, establishment and use of the Internet network in Vietnam, issued together with Decree No.21-CP of March 5, 1997 of the Government and the tasks assigned by the Coordination Committee.
- To participate in all meetings of the Coordination Committee and make their comments on the issues raised for discussion.
- To be provided with necessary working conditions according to the current regime in order to perform their tasks. To be provided with all information related to the activities of the Coordination Committee.
- Depending on their respective specialties, the members of the Coordination Committee shall have specific duties and powers assigned by the Chairman of the Committee.
- To regularly report on the activities of the Coordination Committee to the leading officials of their respective ministries or branches for the coordination of activities with the Coordination Committee.
- To propose matters that need to be adjusted with respect to orientation, policy, implementation measures, planning and designs for the development of Internet network in Vietnam.
4. The Standing Body of the Coordination Committee shall have the following tasks:
- To assist the Chairman in preparing contents, programs and providing working conditions and facilities for activities of the Coordination Committee.
- To help the Chairman firmly grasp the situation, urge the implementation of resolutions adopted by the meetings of the Coordination Committee, summarize facts and make reports according to its tasks assigned by the Coordination Committee.
- Maintain dossiers and documents related to the operation of the Coordination Committee in accordance with regulations of the State.
Chapter II
MODE OF OPERATION AND WORKING RELATIONS OF THE COORDINATION COMMITTEE
Article 4.- General principles:
The Coordination Committee shall meet once every three months and may hold extraordinary meetings at the request of the Prime Minister or at the initiative of its Chairman when there appear urgent tasks.
In case of his/her unexpected absence, a member of the Coordination Committee shall have to authorize in writing the representative of his/her ministry or branch to attend a meeting. The authorized person shall report on the contents and conclusion of the meeting to such Coordination Committee member so that the latter shall be able to take part in the implementation thereof.
The time, venue and agenda of each meeting of the Coordination Committee shall be announced at least 4 days in advance and the agenda documents shall be distributed to the members of the Coordination Committee at least 2 days before the meeting is convened.
When necessary, the Coordination Committee may convene a meeting of the Technical Consultation Council or its enlarged meeting with the participation of scientists, producers, businessmen and representatives of concerned managerial bodies to gather their comments on the management, establishment and use of the Internet network in Vietnam.
Article 5.- The mode of operation of the Coordination Committee:
The Coordination Committee shall work on the principle of democratic discussion. The Chairman shall make summaries, conclusions and decisions on the basis of the general opinion of the majority of members.
The Chairman (or the Vice Chairman or a member of the Coordination Committee, authorized by the Chairman) shall sign reports, decisions, proposals and minutes of the meetings of the Coordination Committee before they are submitted to the Government and its attached agencies.
Article 6.- Funds for the operation of the Coordination Committee:
Operation funds of the Coordination Committee shall be used for the following activities: The elaboration and evaluation of planning, plans, strategy and policy for the development of the Internet network in Vietnam; regular or irregular inspection of the observance of the provisional regulations on the management, establishment and use of the Internet network in Vietnam; the organization of meetings of the Coordination Committee, the Technical Consultation Council and other meetings in service of the managerial work of the Coordination Committee; the provision of working and traveling conditions and means, the printing of documents, the provision of information and materials, and other expenses by decision of the Chairman of the Committee.
Funds for activities of the Coordination Committee shall be allocated from the scientific non-business budget and included into annual plans of the Ministry of Science, Technology and Environment, and shall be used and managed in accordance with current stipulations of the State.
Article 7.- The working relationship between the Coordination Committee and ministries, branches and localities:
- The Coordination Committee shall direct the coordination of activities among ministries and branches which are members of the Coordination Committee in performing the functions and tasks prescribed in Article 2 of Decision No.136-TTg of March 5, 1997 of the Prime Minister, Article 13, Chapter III of the Provisional Regulation on the Management, Establishment and Use of the Internet Network in Vietnam issued together with Decree No.21-CP of March 5, 1997 of the Government and Article 1, Chapter I of this Regulation; shall together with the member ministries and branches periodically evaluate and review the performance of tasks and make proposals and recommendations to the Government on issues related to the management, establishment, use, confidentiality and development of the Internet network in Vietnam.
- The Coordination Committee shall coordinate with the ministries, branches and People�s Committees of the localities in disseminating, guiding, helping and regularly or irregularly inspecting the observance of the Provisional Regulations on the Management, Establishment and Use of the Internet Network in Vietnam issued by the Government within the scope of management of such ministries, branches and localities.
Chapter III
IMPLEMENTATION PROVISIONS
Article 8.- Ministries, branches and localities, agencies and individuals that are members of the National Internet Coordination Committee in Vietnam shall have to implement this Regulation. Any problems arising in the course of implementation must be reported to the Coordination Committee for consideration, supplement or amendment.
