JOINT CIRCULAR No. 01/2004/TTLT-VKSNDTC-BCA-TANDTC-BTP-BQP-BTC of March 25, 2004 guiding the implementation of a number of provisions of the National Assembly Standing Committee's Resolution No. 388/NQ-UBTVQH11 of March 17, 2003 on compensations for damage caused by competent persons in criminal proceeding activities to persons suffering from injustice
This Joint Circular was issued to help properly and uniformly implement the provisions of said Resolution No. 388 on cases eligible for damage compensations (specified in Article 1 of the Resolution) and cases ineligible for damage compensations (specified in Article 2 of the Resolution), suggesting that attention must be paid to some specific cases.
Its also guides the determination of spiritual and material damage and compensation level applicable to each specific damage; the delivery and sending of decisions and judgments; the procedures for restoration of honor, claims for damage compensations, competence and procedures for paying damage compensations at court; compensation funding and payment; and the settlement of disputes over liability to pay damage compensations among competent agencies in criminal proceeding activities.
Promulgated together with this Joint Circular are the set forms of application for damage compensations under Resolution No. 388, written records on negotiations for damage compensations under Resolution No. 388; and decisions on damage compensations for persons suffering from injustice under Resolution No. 388.
This Joint Circular takes effect 15 days after its publication in the Official Gazette.- (Summary)
