DECISION

Approving the planning on development of socialization of cultural activities till 2010

THE MINISTER OF CULTURE AND INFORMATION

Pursuant to the Government's Decree No. 63/2003/ND-CP of June 11, 2003, defining the functions, tasks, powers and organizational structure of the Ministry of Culture and Information;

On the basis of the results of implementation of the Government's Resolution No. 90/CP of August 21, 1997, and Decree No. 73/1999/ND-CP of August 19, 1999, on policies to encourage socialization of activities in the cultural domain;

Pursuant to the Government's Resolution No. 05/2005/NQ-CP of April 18, 2005, on stepping up socialization of educational, medical, cultural, physical training and sport activities;

At the proposal of the chairman of the Culture and Information Ministry's Steering Committee for the implementation of the Government's Resolution No. 05/2005/NQ-CP on stepping up socialization of cultural activities in the 2005-2010 period,

DECIDES:

Article 1.- To approve the Planning on development of socialization of cultural activities till 2010 with the following principal contents:

1. Guiding viewpoints and orientations:

a/ To socialize culture in order to tap all intellectual and material potentials of the entire society to meet increasing cultural demands of the people and, at the same time, create conditions for the entire population, particularly policy beneficiaries, to enjoy culture at a higher and higher level in the period of industrialization, modernization and international integration.

b/ The State continues to renew culture management mechanisms, further perfect other mechanisms and policies to increase investment resources along with renewing investment objectives, methods, structure and sources; concentrate investment resources on priority objectives and national programs on cultural development. To concentrate on supporting and investing in mountainous, border, island, deep-lying, remote and ethnic minority areas hit with many difficulties.

c/ To convert all (public) non-business units in the culture and information branch into ones operating under the mechanism of providing public services, enjoying full autonomy in their organization and management, accounting all costs and balancing their revenues and expenditures; to achieve their objectives and perform their tasks already set, constantly raise the effectiveness and quality of services and products, ensuring benefits and equal creative opportunities for beneficiaries.

To consider and switch part or the whole of some existing non-business cultural and information units (public ones), when they meet the set conditions, to operate in a non-public form under the management of collectives or individuals on the basis of returning capital to the State.

State enterprises, joint ventures and partnerships between state organizations and foreign partners under the management of the information and culture branch shall further be rearranged and renewed to increase their capacity under decisions already approved by the Prime Minister in the form of enterprises with 100% state capital; enterprises in which the State does not need to hold 100% capital may be converted into multi-owner enterprises (joint-stock companies); enterprises which cannot be equitized may be assigned, contracted, auctioned, dissolved or bankrupted according to current regulations.

d/ To strongly develop non-public establishments in two forms, people-founded and private: Individuals, families, socio-economic organizations and mass organizations may invest and participate in most culture and information activities, except the establishment of publishers, press agencies and mobile information teams. The State encourages and adopts preferential policies for investment in key cultural and information activities contributing to political and ideological orientation, social ethics, tastes and values; in the conservation and promotion of the values of cultural heritages, traditional and folk arts and fine customs and practices of the nation; or in the establishment of non-public units operating under a non-profit mechanism.

e/ To develop socialization of cultural activities in parallel with enhancing state management and intensifying inspection and supervision of cultural activities with a view to ensuring cultural and information development in line with the Party and State's orientation.

f/ The process of planning development of socialization of cultural activities should involve different steps suitable to each form of cultural activity, area and region, attaching importance to strongly developing socialization of cultural activities in big cities, urban centers and economically developed regions.

2. Objectives of the Planning

a/ To tap all resources and attract all economic sectors and strata of people to take part in creating, supplying and disseminating cultural products and works which are quality, rich, diversified, national and modern in order to constantly raise the level of cultural enjoyment for the people.

b/ By 2010, non-public establishments and forces involved in the socialization of cultural activities shall ensure 40-60% of the demand for cultural services, depending on each form and domain, and capital mobilized from the society shall account for 49%.

c/ To convert 100% public units (non-business units) in the culture and information branch which are applying the financial autonomy regime applicable to revenue-generating units under the Government's Decree No. 10 into ones operating under the service-providing mechanism (cultural service-providing units) after legal documents on the new mechanism are promulgated. From 2006, to select a number of units for conversion, which shall draw up a plan and prepare material foundation and personnel conditions, mechanisms and policies for experimental conversion into non-public ones when all conditions are met. Experience will then be drawn therefrom for large-scale conversion.

d/ To formulate and promulgate a system of mechanisms and policies suitable and conducive to the development of socialization of cultural activities.

3. Contents of the Planning on development of socialization of cultural activities

a/ Developing socialization of cultural activities on the basis of arranging existing non-business units of the culture and information branch in the following orientations:

- To rearrange art units in the following direction: To maintain central traditional and typical art troupes in the public form, such as classical drama, traditional operetta, reformed theater, circus, national song, dancing and music, symphony, ballet, puppetry, music and opera troupes. To maintain in each province only one traditional and typical art troupe. In provinces and cities where exist more than one public art troupe, the provincial-level People’s Committees shall consider and reduce the number of such troupes (by converting them into non-public ones or merging them) and maintaining only those typical of their localities. To quickly switch all public art troupes to operate under the mechanism of providing art performance services when such mechanism is enforced. Depending on the characteristics of each area, region and practical operation, to step by step convert other central and local art units into non-public ones collectively or individually managed on the basis of refunding capital to the State.

- In the training domain, to continue maintaining and developing in the public form central literature and art cadres' training schools and professional and technical vocational schools focussing on fostering talents, training in premier arts, training leading cultural and art cadres, ethnic minority cultural and art cadres and cadres for special occupations in order to build a contingent of key cadres who are both virtuous and talented, playing a key role in state management units and public units (including 15 leading cultural and art universities, colleges and intermediate schools and one intermediate school providing vocational training in printing, a special trade, which is in the course of being upgraded to collegial level). To continue maintaining in the public form locally managed cultural and art cadres' training colleges and intermediate schools. Provincial-level People's Committees shall consider and convert them into people-founded or private cultural and art schools when they meet all conversion conditions.

To encourage public cultural and art schools to separate some of their departments or faculties not involved in training top and specialized cultural and art cadres for establishment of people-founded or private cultural and art schools.

- Museums, relic management boards, specialized libraries and provincial, municipal and district libraries nationwide shall be maintained and developed in the public form (units providing services in the domain of cultural heritages or libraries) so as to preserve, popularize and conserve cultural values of the nation and mankind.

- The system of publishers, media agencies, cultural and information centers (including exhibition centers, cultural centers, information centers; cultural houses and exhibition halls); movie distribution centers in mountainous, deep-lying and remote areas; mobile information teams at central and local levels, which are units and organizations disseminating Party orientations, lines and policies and State laws, shall be maintained and developed in the public form (units providing services in the domain of publication, press, information and propaganda).

The State encourages and assigns provincial-level People's Committees to consider and convert cultural and information centers in big cities, urban centers and economically developed areas into non-public units when all conditions are met.

Provincial-level People's Committees shall consider and make decisions according to their competence to convert movie distribution centers not located in mountainous, deep-lying or remote areas into non-public ones. The process of conversion must have appropriate steps suitable to the characteristics of each region and area and conversion will be effected only when conditions permit.

- To quickly switch all public units operating in the cultural and information domain to operate under the service-providing mechanism after such mechanism is enforced.

b/ Socializing cultural and information activities at grassroots level:

- Activities of grassroots cultural and information institutions: To allow and encourage individuals, non-public units and organizations to establish grassroots cultural and information institutions in provinces, cities, urban and rural districts, communes, wards, townships, villages and hamlets on the principles of independent organization and self-management and under the state management by competent agencies.

- Building a cultured life at grassroots level: Individuals, non-public units and organizations may invest in, join and coordinate with State-run public organizations in building a cultured life at grassroots level according to regulations of the culture and information branch and State orientations; take part in formulating village regulations and codes in compliance with the provisions of law; register and organize new and traditional festivities (excluding national festivals), weddings and funerals under the State guidance and on the basis of independent organization and self-management.

- Mass cultural and art performance activities: Individuals, non-public units and organizations may invest and participate in mass cultural and art performance activities in communes, wards, agencies and units on the principles of independent organization and self-management and under the state management by competent agencies.

The State shall consider and support some or all initial material conditions for grassroots cultural and information activities organized and carried out to serve the people in mountainous, island, special, ethnic minority areas or areas hit by extreme difficulties.

c/ Socializing some specialized cultural activities:

To encourage individuals and units of other economic sectors to participate in specialized cultural activities: Art, cultural and art training, cinematography (including all three stages of production, import and movie distribution-movie show), printing-distribution, cultural heritage, fine art-photography, library, copyright protection services.

d/ Socializing state enterprises managed by the culture and information branch: To implement the Prime Minister's Decision No. 103/2003/QD-TTg of May 27, 2003, and Decision No. 226/2005/QD-TTg of September 15, 2005, on arrangement, renewal and raising of efficiency of state enterprises and the Culture and Information Ministry's Scheme on continued arrangement and renewal of enterprises.

4. Major solutions:

a/ To promote propaganda to raise public awareness about the Party's line and State's mechanisms and policies on encouraging socialization of cultural activities, attaching special importance to changing the awareness among state management agencies of all branches from the central to local level about the guideline on socialization of cultural activities.

b/ To concentrate on theoretical research and conduct periodical reviews of the socialization of cultural activities so as to establish scientific grounds for orienting the process of realization of the Planning on development of socialization of cultural activities.

c/ To coordinate with concerned ministries and branches (Finance, Planning and Investment, Justice, Education and Training, Health, Physical Training and Sports') in formulating, supplementing and amending legal documents for submission to the Government so as to perfect the legal system governing culture and renew state management mechanisms, creating a uniform legal setting and management mechanisms for developing socialization of cultural activities till 2010: Reviewing, supplementing and amending a number of current documents (Decree No. 10/2002/ND-CP on the switch to the service-providing mechanism; Decree No. 73/1999/ND-CP for expanding and adding incentive policies for socialization); incentive policies to encourage investment, provide initial supports for a given period regarding material bases and entitlements granted to laborers working in public organizations converted into non-public ones. To formulate regimes and policies clearly defining the benefits, responsibilities and obligations of individuals and economic sectors when they participate under the service-providing mechanism for profit or not for profit. To formulate and perfect master plans of the culture and information branch; perfect operation models and regulations of public units and financial regimes of units providing cultural services. To renew mechanisms of state budget use, such as applying the policy on bidding for the provision of services under the State's orders so as to encourage the participation of all economic sectors; changing the mechanism of providing supports to cultural beneficiaries through public units to the one of providing supports directly to beneficiaries; and renewing the state management mechanism in conformity with the Government's administrative reform.

d/ To increase investment in culture from the central and local budgets so as to conserve and promote the nation's cultural heritages, prioritizing investment in ethnic minority, mountainous and extreme difficulty-hit areas: To increase investment so as to enhance the leading role of state cultural agencies and units. To invest in cultural and art training establishments, in the conservation of cultural heritages and adopt priority policies for mountainous areas. The State shall earmark an appropriate state budget proportion to support units converted into non-public ones in upgrading their material bases, equipment, technologies' so as to effectively implement the national target culture program.

e/ To well implement legal documents in the cultural and relevant domains so as to expand and diversify forms of socializing cultural activities for various economic sectors.

f/ To intensify inspection and supervision.

g/ To concentrate on studying and formulating a number of specific mechanisms and policies and propose the State to promulgate them in order to facilitate development of socialization of cultural activities, such as policies on training and re-training cadres; policies on mobilization of resources and funds (preferential tax policies), land use, social affairs and rewards.

5. Implementation timetable

a/ The 2005-2006 period:

- To widely disseminate the Planning on development of socialization of cultural activities on the mass media and promulgate documents guiding the implementation of the Planning.

- To coordinate with concerned agencies in formulating, supplementing and amending before submitting to the Government, ministries or branches for promulgation mechanisms and policies to encourage development of socialization of cultural activities.

- To switch 100% units currently operating under the Government's Decree No. 10 to operate under the service-providing mechanism (cultural service-providing units) after the new mechanism is enforced.

- To select a number of units planned for conversion (with a high probability of self-financing) which shall draw up schemes on conversion into the non-public form (mostly in the people-founded form).

- To accelerate the arrangement and renewal of state enterprises when the Scheme on continued arrangement and renewal of state enterprises in the culture and information branch comes into force. For enterprises required to change their form of ownership, enterprises with competitive advantages on the market shall be converted first.

- To prioritize the formation of non-public establishments for socializing the production of cultural products, invest material bases and equipment in building cultural structures and institutions in each region and area.

- By the end of 2006, to hold a preliminary review of the implementation of the Planning on development of socialization of cultural activities, drawing experience and setting implementation orientations in the 2007-2010 period.

b/ The 2007-2010 period:

- To continue formulating, revising and supplementing legal documents on further socialization of cultural activities and implementation of the Planning on development of socialization of cultural activities.

- To convert, when conditions permits, on an experimental basis units which have drawn up their conversion plans, and draw experience for large-scale conversion. To strive to achieve by 2010 all the targets set in the Planning nationwide. After 2010, the State shall review the practical conditions and adjust the orientations for socialization of cultural activities, including consideration and re-determination of the number of public units which need to be maintained.

- To conduct annual reviews and a final review after five years' development of socialization of cultural activities, paying attention to drawing on experience on the formulation and development of socialization models typical of each region, area and domain for nationwide expansion.

Article 2.- Organization of implementation

- The Steering Committee for implementation of the Government's Resolution No. 05 on stepping up socialization of cultural activities in the 2005-2010 period, set up by the Ministry of Culture and Information (called the Central Steering Committee for short), shall be responsible for assisting the Minister of Culture and Information in implementing this Resolution and the Government's documents directing further socialization of cultural activities in the entire branch in the 2005-2010 period; directing the experimental and expanded socialization work in the entire branch in accordance with the Government's guideline and the Planning on development of socialization of cultural activities till 2010 nationwide.

- Provincial/municipal People's Committees shall base themselves on local socio-economic conditions to direct provincial/municipal Culture and Information Services to formulate and implement local plannings on development of socialization of cultural activities till 2010 in line with the approved planning of the Ministry of Culture and Information.

Article 3.- This Decision takes effect 15 days after its publication in "CONG BAO."

Article 4.- Provincial/municipal People's Committees, the director of the Office, the director of the Organization and Personnel Department, the director of the Planning and Finance Department, heads of units under the Ministry, and directors of provincial/municipal Culture and Information Services shall have to implement this Decision.
