DECISION No. 64/2002/QD-BKHCNMT OF AUGUST 12, 2002 ISSUING THE REGULATION ON ORGANIZATION AND OPERATION OF THE BOARD FOR PREPARATION AND MANAGEMENT OF THE PROJECT ON SUPPORTING THE HUMAN RESOURCE DEVELOPMENT FOR SOFTWARE INDUSTRY

THE MINISTER OF SCIENCE, TECHNOLOGY AND ENVIRONMENT

Pursuant to the Government�s Decree No. 22/CP of May 22, 1993 on the tasks, powers and organizational apparatus of the Ministry of Science, Technology and Environment;

Pursuant to the Government�s Decree No. 17/2001/ND-CP of May 4, 2001 on the Regulation on the management and use of official development assistance;

Pursuant to Decision No. 550/QD-TCCBKH of May 12, 1997 of the Minister of Science, Technology and Environment, issuing the Charter on organization and operation of the Ministry�s Office;

Pursuant to Decision No. 1553/QD-BKHCNMT of July 17, 2002 of the Minister of Science, Technology and Environment, establishing the Board for Preparation and Management of the Project on supporting the human resource development for software industry;

At the proposals of the director of the Project Preparation and Management Board, the director of the Ministry�s Office and the director of the Department for Organization and Scientific Personnel,

DECIDES:

Article 1.- To issue together with this Decision the Regulation on organization and operation of the Board for Preparation and Management of the Project on supporting the human resource development for software industry.

Article 2.- This Decision takes effect 15 days after its signing.

The director of the Project Preparation and Management Board, the director of the Department for Organization and Scientific Personnel, the director of the International Relation Department, the director of the Ministry�s Office, and the heads of the concerned units shall have to implement this Decision.

REGULATION ON ORGANIZATION AND OPERATION OF THE BOARD FOR PREPARATION AND MANAGEMENT OF THE PROJECT ON SUPPORTING THE HUMAN RESOURCE DEVELOPMENT FOR SOFTWARE INDUSTRY

(Issued together with Decision No. 64/2002/QD-BKHCNMT of August 12, 2002 of the Minister of Science, Technology and Environment)

Chapter I

GENERAL PROVISIONS

Article 1.- The Board for Preparation and Management of the Project on supporting the human resource development for software industry (called the Executive Agency for short) was set up under Decision No. 1553/QD-BKHCNMT of July 17, 2002 of the Minister of Science, Technology and Environment.

Article 2.- The Executive Agency is placed at the Ministry of Science, Technology and Environment and operates under the direction of the director of the Ministry�s Office. The Executive Agency may use the seal and account of the Ministry�s Office. The working office of the Executive Agency shall be considered and arranged by the Ministry�s Office.

The Executive Agency may use its international transaction name: Executive Agency of the Project on Supporting the Human Resource Development for Software Industry (abbreviated to HUDESI).

Chapter II

FUNCTIONS AND TASKS

Article 3.- Functions of the Executive Agency

The Executive Agency shall assist the director of the Ministry�s Office in preparing and managing the Project funded with the non-refundable aid capital of the Indian Government for supporting the human resource development for software industry.

Article 4.- Tasks of the Executive Agency

1. Acting as the sole coordinator between the Indian representative agency, domestic and foreign agencies in performing the work related to the project preparation.

2. Managing and organizing the implementation of the Project after it is officially approved by the Government.

3. Preparing and submitting to competent authorities reports on the project implementation, financial reports; evaluating the project implementation results on the basis of close cooperation with, and synthetization of the reports of, the units benefiting from the Project�s support activities.

4. Taking responsibility for the efficient use of the Project�s capital source for contributing to enhancing the capacity of the human resource development for software industry for the units benefiting from the Project�s support activities.

Chapter III

ORGANIZATIONAL APPARATUS AND OPERATION

Article 5.- The director of the Executive Agency shall be responsible to the director of the Ministry�s Office for all activities of the Project; be entitled to and take responsibility for organizing the performance of the tasks defined in Article 4 of this Regulation.

The director shall be assisted by a deputy director. Where the director is absent, the deputy director shall be authorized to run and settle on the director�s behalf the work of the Executive Agency after obtaining the consent of the director of the Ministry�s Office.

Article 6.- The Project�s staffs working on a part-time basis shall enjoy remuneration according to the current regime and staffs working under labor contracts shall get paid from the project�s operation fund. The director of the Executive Agency shall decide on the arrangement of staffs working in various teams and define the specific tasks of each team.

Article 7.- The operation fund of the Executive Agency shall come from the project�s funding source.

Chapter IV

WORKING RELATIONS

Article 8.- The Executive Agency shall comply with the working regime and have working relations with the units attached to the Ministry�s Office and functional units according to the working regulations of the Ministry.

The Executive Agency shall coordinate the Project�s support activities for the benefiting units and assume the prime responsibility for performing the tasks defined in Article 4 of this Regulation.

The director of the Executive Agency may represent the director of the Ministry�s Office in working with concerned agencies, organizations at home and abroad after he/she is so authorized by the director of the Ministry�s Office.

Chapter V

IMPLEMENTATION PROVISIONS

Article 9.- This Regulation takes effect 15 days after its signing.

Article 10.- The director of the Ministry�s Office, the director of the Department for Organization and Scientific Personnel and the director of the Executive Agency shall have to organize the implementation of this Regulation.

Article 11.- When it is necessary to amend and/or supplement this Regulation, the director of the Executive Agency shall report such amendments and/or supplements to the director of the Ministry�s Office for coordinating with the director of the Department for Organization and Scientific Personnel in submitting them to the Ministry�s leadership for consideration and decision.
