CIRCULAR No.37-TC/TCT OF JUNE 25, 1997 SUPPLEMENTING INTER-MINISTERIAL CIRCULAR No.51-TT/LB OF JULY 3, 1995 OF THE MINISTRY OF FINANCE AND THE MINISTRY OF HEALTH ON THE REGIME OF COLLECTION, MANAGEMENT, USE OF THE FEE FOR EVALUATION AND GRANT OF ELIGIBILITY CERTIFICATES FOR SETTING UP PRIVATE MEDICAL AND PHARMACEUTICAL ESTABLISHMENTS AND THE FEE FOR ISSUE OF REGISTERED NUMBERS OF DRUG ITEMS

Pursuant to Decree 86-CP of December 8, 1995 of the Government on the assignment of State management responsibilities for the quality of goods;

Pursuant to Decision No.276/CT of July 28, 1992 of the Chairman of the Council of Ministers (now the Prime Minister) on the uniform management of fees and the opinions of the Prime Minister in Official Dispatch No.81/KTTH of January 6, 1997 of the Office of the Government on the collection of fees and charges by the health service;

After a period of implementation and consultation with the Ministry of Health, the Ministry of Finance guides the supplements to Inter-ministerial Circular No.51-TT/LB of July 3, 1995 of the Ministry of Finance and the Ministry of Health on the regime of collection, management and use of the fees paid for the evaluation and grant of certificates of eligibility for setting up private medical and pharmaceutical establishments and the fees for issuance of registered numbers for drug items, as follows:

1. To supplement Section I on the fee payers who are Vietnamese and foreign organizations and individuals filing applications for registration of cosmetic quality.

2. To supplement Section II on the amount of fee to be collected from issuing numbers of quality registration of cosmetics items, as follows:

- Foreign goods imported into Vietnam: 2,500,000 VND/item;

- Domestically produced goods: 300,000 VND/item.

3. This Circular takes effect 15 days after its signing. All previous stipulations regarding the fees to be paid for the evaluation and grant of certificates of quality registration of cosmetics which are contrary to this Circular are now annulled. Other stipulations shall still be implemented in accordance with the guidance of Inter-ministerial Circular No.51-TT/LB of July 3, 1995 of the Ministry of Finance and the Ministry of Health on the collection, management and use of the fees paid for evaluation and issuance of certificates of eligibility for setting up private medical and pharmaceutical establishments and the fees for issuance of registered numbers for drug items.

Any problems arising in the course of implementation must be promptly reported to the Ministry of Finance for consideration and solution.
