DECREE No.89-CP OF DECEMBER 15, 1995 OF THE GOVERNMENT ON REVOKING THE PROCEDURES FOR GRANTING EXPORT OR IMPORT PERMIT FOR EACH CONSIGNMENT

THE GOVERNMENT

DECREES:

Article 1.- To revoke procedures whereby the Ministry of Trade grants export or import permit for each consignment of goods (lot of goods).

Article 2.- On the basis of the State's general export-import quotas, the Ministry of Trade grants export and import permits to the following items and groups of goods:

1. Export and import goods under quota control.

2. Consumer goods imported under annual plans, either in kind or in monetary value, approved by the Prime Minister.

3. Machinery, equipment (including equipment in single units or complete sets) imported with budget capital, as stipulated in Decision No.91-TTg of November 13, 1992 of the Prime Minister on the management of the import of machinery and equipment with capital source from the State budget.

4. Goods of enterprises established under the Law on Foreign Investment in Vietnam.

5. Goods in service of oil and gas exploration and exploitation under joint venture investment licenses.

6. Goods for expositions and fairs.

7. Sub-contracted goods.

8. Goods temporarily imported for re-export, transit goods, goods imported under the regulation on sale agent(s) for foreign country (ies), goods imported for duty-free shops.

9. Export and import goods subject to control so as to ensure the supply-demand balance in the country shall comply with the lists announced by the Ministry of Trade, after approval of the Prime Minister.

After getting permits from the Ministry of Trade for the above-said kinds of goods, the enterprise shall fill procedures at the Customs office for exporting or importing these goods without need of consignment permit.

Article 3.- The following specialized managing agencies shall, within their scope of managerial function, consult with the Ministry of Trade about the annual lists of goods which need to be certified by the specialized managing agencies before their export or import and submit them to the Prime Minister for approval and public announcement. At the same time they have to assign to functional agencies, which are attached to them, the responsibility to consider, confirm applications for exporting or importing goods (including sample goods) included in this list:

1. The Ministry of Industry:

- Commodity minerals (for export).

- Ferrous and non-ferrous metal scraps (for export).

2. The Ministry of Agriculture and Rural Development:

- Forest animals and plants (for export).

- Technology for wood and forestry product processing (for import).

- Wood products for export (except fine-arts products).

- Living animals and plants for breeds in agriculture (for import).

- Animal feeds (for import).

3. The Ministry of Health (for import):

- Pharmaceuticals and materials for the production of pharmaceuticals for medicaments for man.

- Equipment, machinery, tools for diagnosis and treatment of human diseases.

4. The Ministry of Finance, (The Commission for Managing and Receiving International Aid Goods - for import):

- Aid goods.

5. The Ministry of Aquatic Products (for export, import):

- Living aquatic species as breeds.

- Rare and precious aquatic species.

- Pharmaceuticals and feeds for aquatic farming.

6. The Ministry of Culture and Information (for export, import):

- Books, newspapers, paintings, photographs and other cultural products (except goods labels and catalogs).

- Fine-art works of high value under State control.

- Printing equipment, recorded video tapes.

- Cinematographic works.

7. The Ministry of Defense (for export, import):

- Weapons, military technical equipment and gear.

- Ammunition, explosive materials for national defense.

- Technological documents and processes for the production and repair of weapons and military technical equipment.

- Military uniforms and goods.

8. The State Bank (for export, import):

- Specialized equipment and machinery for the banking service.

9. The General Post Office (for export, import):

After receiving confirmations from the above-said agencies, the enterprise shall fill procedures for export or import at the Customs office, without having to apply for consignment import - export permits.

For forest animals and plants, permits from the Ministry of Agriculture and Rural Development shall be required as prescribed in the CTTES International Convention and Decree No.18-HDBT of January 17, 1992 of the Government; for medicines, habit-forming substances, phychotropic drugs, essences when imported, permits from the Ministry of Health shall be required as prescribed in the 1961 International Convention on NARCOTIC DRUGS.

In case of goods for payment of foreign debts, after the Ministry of Finance announces that they are the bid winners (if the goods are put on bidding) or the Ministry of Planning and Investment announces quotas (if the goods are allotted by quotas), the enterprise shall fill procedures for export at the Customs Office.

The bills and export-import contracts listed in Article 3, which were signed before January 1st, 1996 shall be valid until after the expiry of the contracts.

Article 4.- Goods, which are not on the lists of goods banned from export or import and not in the area defined in Article 2 and Article 3 of this Decree, shall be allowed to be exported or imported, depending on the needs of the enterprise. When exporting or importing these kinds of goods, the enterprise having export-import licenses granted by the Ministry of Trade and the right kinds of goods shall have not to ask for export or import permits from any agencies, and only to fill procedures for export or import at the Customs Office.

Article 5.- The responsibilities for managing and supplying information on export, import activities, on goods for export and import, on supervising the collection and payment of foreign currencies...shall be assigned as followed:

1. The Ministry of Trade is responsible for strictly managing export-import activities of the enterprises, especially the export or import of items vital for the national economy. On the basis of reports from the General Customs Department, the Ministry of Trade shall inform the enterprises and concerned agencies of the export-import situation in each period so that the enterprises can make their activities conformable to the domestic and foreign markets. In case of necessity, the Ministry of Trade shall propose to other branches and submit to the Prime Minister the readjusted plans to suit the actual situation, including the application of situation measures to the granting of permits for export or import of consignment of important items.

2. The General Customs Department is responsible for inspecting and supervising goods and collecting export and import taxes; supplying in time to the Ministry of Trade, the Ministry of Planning and Investment, the General Department of Statistics and the Office of the Government facts and figures about the exportation and importation of each type of goods by each ministry, province, city, enterprise to/from each foreign country, once every 10 days.

3. The State Bank is responsible for examining and supervising the collection and payment of foreign exchange in export-import enterprises.

Article 6.- This Decree takes effect from February 1st, 1996, revoking Article 22 of Decree No.33-CP of April 19, 1994 of the Government on the State management of export-import activities, and Decision No.297/TMDL/XNK of April 9, 1992 of the Minister of Trade and Tourism on permits for exporting or importing goods, and other documents contrary to this Decree.

The Ministry of Trade shall coordinate with the concerned Ministries and branches in issuing inter-ministerial Circulars to guide and organize the implementation of this Decree on schedule.

Article 7.- The Ministers, the Heads of the ministerial-level agencies, the Heads of the agencies attached to the Government and the Presidents of the People's Committees of the provinces and cities directly under the Central Government have to implement this Decree.
