DECISION No. 132/2002/QD-TTg of October 8, 2002 on the allotment of production and residential land to local ethnic minority people in the Central Highlands

To allot land to local ethnic minority people in the Central Highlands so as to ensure that such people, who earn their livelihood from agricultural and/or forestry production, have production and residential land to stabilize their life and step by step raise their living standards, thus consolidating the national unity bloc, boosting socio-economic development and maintaining national security and defense in the Central Highlands.

To strive to basically complete the land allotment to local ethnic minority households having no or inadequate production land and no residential land by 2003.

The minimum level of agricultural production land and residential land to be assigned to one household is 1.0 ha of milpa or 0.5 ha of one-crop wet-rice field or 0.3 ha of two-crop wet-rice field and 400 m2 of residential land; for land with perennial trees, the to be-allotted land area shall be determined on the basis of the actual exploitation capacity of the gardens and the practical land shortage situation in each locality. In cases where agricultural land is not available, forestry land shall be assigned; the assignment levels shall comply with the Government�s Decree No. 163/1999/ND-CP of November 16, 1999 on the assignment and leasing of forestry land to organizations, households and individuals for stable and long-term use for forestry purposes.

Land fund for allotment shall include:

- Land transferred from agricultural and forestry farms;

- Land recovered from agricultural and forestry farms under decisions of competent authorities in necessary cases;

- Land recovered from enterprises which operate inefficiently, use land for wrong purposes, or are dissolved;

- Land adjusted from peasant households which have a lot of land and voluntarily transfer their land use right;

- Land reserved for public-utility demand under the commune administrations� management;

- Land reclaimed from uncultivated land, bare hills and unused land;

- Forestry land with water irrigation and land with exhausted forests and low economic efficiency, which are allowed to be turned into land for agricultural production.

Local ethnic minority households that live on agricultural and/or forestry production but have no or inadequate production land and have the demands therefor shall be assigned land directly by the competent People�s Committees. Within 10 years, households assigned with land must not transfer or mortgage such land in any forms. Organizations and individuals that undertake the transfer or mortgage of land of these households shall be subject to land confiscation without any compensation by competent State agencies in the localities.

Households having no residential land shall be assigned land for building dwelling houses and granted land use right certificates for stable and long-term use of land.- (Summary)
