RESOLUTION

On the national Assembly's law- and ordinance-making programs for the XIIth tenure (2007-2011) and for 2008

THE NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC OF VIETNAM

Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 51/2001/QH10;

Pursuant to the Law on Organization of the National Assembly;

Pursuant to the Law on Promulgation of Legal Documents;

After examining the National Assembly Standing Committee's Report No. 71/TTr-UBTVQH12 of November 12, 2007, on the National Assembly's tentative law- and ordinance-making programs for the XIIth tenure (2007-2011) and for 2008, and considering opinions of National Assembly deputies,

RESOLVES:

Article 1.- To adopt the National Assembly's law- and ordinance-making program for the XIIth tenure with 128 bills and draft ordinances, including 93 drafts under the official program (83 bills and 10 draft ordinances) and 35 bills under the preparatory program (see List 1 for details).

Article 2.- To adopt the law- and ordinance-making program for 2008 with 54 bills and draft ordinances, including 44 drafts under the official program (36 bills and 8 draft ordinances) and 10 bills under the preparatory program (see List 2 for details).

Article 3.- To assign the National Assembly Standing Committee to direct the implementation of the National Assembly's law- and ordinance-making program for the XIIth tenure and the law- and ordinance-making program for 2008; and submit to the National Assembly the annual law- and ordinance-making program of a year at the year-end session of the preceding year. When necessary, the National Assembly Standing Committee may adjust or supplement law- and ordinance-making programs and report thereon in time to the National Assembly.

Article 4.-

In order to effectively implement the National Assembly's law- and ordinance-making programs for the XIIth tenure and for 2008, the following solutions should be implemented:

1. The Government, the Supreme People's Court, the Supreme People's Procuracy, other agencies and organizations that may submit bills and draft ordinances shall set up soon or consolidate committees for drafting laws and ordinances; renew the processes of preparing and examining bills and draft ordinances in order to arrange appropriate time for discussing drafts; and keep regular contact with the National Assembly Standing Committee, the Nationalities Council and National Assembly Committees in lawmaking work;

2. Law- and ordinance-drafting agencies and bill- and draft ordinance-submitting agencies and organizations shall draw up plans for ensuring compliance with the process, progress and quality of preparation of drafts; and strictly implement legal provisions on the time limit for sending bills and draft ordinances to the Government, verifying agencies, the National Assembly Standing Committee and the National Assembly;

3. The Nationalities Council and National Assembly Committees shall take the initiative in closely coordinating with law- and ordinance-drafting agencies and bill- and draft ordinance-submitting agencies and organizations in improving the quality of verification work; delegations of National Assembly deputies and National Assembly deputies shall spend appropriate time on studying, discussing and commenting on bills and draft ordinances for their finalization;

4. The National Assembly Standing Committee shall take measures to ensure the implementation of law- and ordinance-making programs; concentrate efforts on directing the preparation, adjustment and finalization of bills and draft ordinances; and ensure that drafts submitted for passage are well prepared substantially and technically;

5. To continue consolidating legislative work-assisting bodies of the Government, ministries, the National Assembly Standing Committee, the Nationalities Council and National Assembly Committees to be strong enough for well fulfilling their assigned tasks; to draw up plans for attracting lawyers, specialists and scientists in drafting, verifying, adjusting and finalizing bills and draft ordinances.

This Resolution was adopted on November 21, 2007, by the XIIth National Assembly of the Socialist Republic of Vietnam at its second session.
