CIRCULAR NoCIRCULAR No. 08/2001/TT-BGTVT of May 16, 2001 guiding the wearing of helmets when riding motorcycles or mopeds
As from June 1, 2001, those who ride on motorcycles or motorbikes (including children) moving on Vietnam�s land road system must wear crash helmets. However, based on the actual situation, in the immediate future, those who do not wear helmets when on mopeds or motorbikes moving on inner areas of cities shall not be fined, but admonished only.
Those who ride on motorcycles or mopeds moving on Vietnam�s land road system are Vietnamese and foreign nationals, including the vehicles� operators and the pillion riders.
Crash helmets are those produced under Vietnam�s Standard TCVN 5756-2001, and are expertised by the Vietnam Register for their conformity with quality criteria and affixed with stamp certifying such expertise.
Vietnam�s land road system include national highways, provincial roads, district roads, commune roads, urban roads and special-use roads.
Motorcycles and mopeds moving on land roads are divided as follows:
- Mopeds are land road motorized two-wheelers operated by engines with cylinder capacity of under 50 cm
3 and a maximum designed speed of not more than 50 km/h.- Motorcycles are land road motorized two- or three- wheelers operated by engines with cylinder capacity of over 50 cm
3 and a total weight of up to 400 kg.Before May 31, 2001 Vietnam Land Road Administration, the provincial/municipal Communications and Transport Services or Communications and Public Works Services shall have to complete the placement of signal boards on all routes, in order to clearly point out the limit and range of cities� inner areas.
Before May 31, 2001, the Vietnam Register shall have to publicly announce on the mass media the places, procedures and criteria of expertise of helmets; expertise stamps affixed on helmets, types and categories of helmets already expertised.- (Summary)
