DECISION No. 456/2003/QD-NHNN OF MAY 12, 2003 AMENDING AND SUPPLEMENTING CLAUSE 1, ARTICLE 1 OF THE REGULATION ON INTER-BANK ELECTRONIC CLEARING PAYMENT, PROMULGATED TOGETHER WITH THE STATE BANK GOVERNOR’S DECISION No. 1557/2001/QD-NHNN OF DECEMBER 14, 2001

THE STATE BANK GOVERNOR

Pursuant to State Bank Law No. 01/1997/QH10 and Credit Institutions Law No. 02/1997/QH10 of December 12, 1997;

Pursuant to the Government’s Decree No. 86/2002/ND-CP of November 5, 2002 defining the functions, tasks, powers and organizational structures of the ministries and ministerial-level agencies;

Pursuant to the Government’s Decree No. 64/2001/ND-CP of September 20, 2001 on activities of payment via payment service-providing organizations;

Pursuant to the Prime Minister’s Decision No. 44/2002/QD-TTg of March 21, 2002 on the use of electronic vouchers as book-keeping documents for accounting and settling capital of payment service-providing organizations;

At the proposal of the director of the Accountancy - Finance Department,

DECIDES:

Article 1.- To amend and supplement Clause 1, Article 1 of the Regulation on inter-bank electronic clearing payment, promulgated together with the State Bank Governor’s Decision No. 1557/2001/QD-NHNN of December 14, 2001 as follows:

"1. This Regulation governs the operation of clearing via computer networks payment amounts in Vietnam dong (VND) among banks and other organizations licensed to provide payment services, operating in the Vietnamese territory and opening deposit accounts at the same unit of the State Bank, which shall organize and assume the prime responsibility for the electronic clearing payment.

a/ The level of payments via the inter-bank electronic clearing:

- For payment orders among banks within the geographical area of a province or city, the maximum level is unlimited.

- For electronic clearing payment orders for transfer to banks in other provinces or cities, the maximum level is the floor value prescribed by the State Bank Governor for each period.

b/ All transferred debit amounts in the inter-bank electronic clearing must be effected under prior authorization: Member banks shall have to sign debt transfer contracts with one another and notify in writing the main responsible bank before effecting the transfer."

Article 2.- This Decision takes effect 15 days after its publication in the Official Gazette.

Article 3.- The director of the Office, the director of the Accountancy - Finance Department, the director of the Department for Banking Information Technology, the heads of the units attached to the State Bank, the director of the State Bank’s Transaction Bureau, the directors of the State Bank’s branches in the provinces and centrally-run cities, the general directors (directors) of the banks and other organizations licensed to provide payment services shall have to implement this Decision.
