DECISION No.917/1997/QD-TTg OF OCTOBER 29, 1997 ON THE ESTABLISHMENT OF THE NATIONAL COMMITTEE FOR TRAFFIC SAFETY

THE PRIME MINISTER

Pursuant to the Law on Organization of the Government of September 30, 1992;

Considering the requirements of the work of ensuring traffic order and safety;

At the proposals of the Minister of Communications and Transport, the Minister of the Interior and the Minister-Chairman of the Government Commission on Organization and Personnel,

DECIDES:

Article 1.- To set up the National Committee for Traffic Safety to coordinate operations of the ministries, branches and localities in well performing the work of ensuring traffic order and safety.

The National Committee for Traffic Safety shall have its own seal and bank account at the State Treasury. The fund for its operations shall be allocated from the State budget according to the ratified plan.

Article 2.- The National Committee for Traffic Safety shall have the following tasks and powers:

To advise the Prime Minister on the undertakings, policies, legal documents regarding the field of ensuring traffic order and safety, which are submitted to the Government or the Prime Minister by the ministries, branches and localities.

To propose the Prime Minister inter-branch measures to ensure traffic order and safety and organize coordination with the branches and localities in the implementation of the measures already ratified.

3. To organize coordination among central agencies and concerned organizations, People�s Committees of the provinces and cities directly under the Central Government in the enforcement of the legal documents and regulations on road, railway, seaway, inland waterway and airway traffic order and safety (traffic order and safety for short).

To coordinate with the concerned agencies and organizations in widely popularizing and disseminating among people from all walks of life the provisions of law on traffic order and safety and educating the sense of strictly implementing such provisions.

To organize coordination with the concerned State agencies and the People�s Committees of the provinces and cities directly under the Central Government in inspecting the observance of the regulations on traffic order and safety.

To urge branches and localities to apply measures to ensure traffic safety in areas with traffic complexities.

To organize coordination between branches and levels in promptly overcoming consequences of serious traffic accidents.

To organize coordination of operations between the traffic inspectorates of different levels (central and local) and the People�s Police forces in inspecting and supervising the implementation of the regulations on ensuring traffic order and safety throughout the country.

To sum up the situation on traffic order and safety in the whole country and regularly report it to the Prime Minister.

To be entitled to establish relations and enter into cooperation with foreign countries and international organizations so as to exchange experiences and promote scientific-technological cooperation in the field of ensuring traffic order and safety.

Article 3.- The National Committee for Traffic Safety is composed of:

The Chairman: A Vice Minister of Communications and Transport.

The Vice Chairman: A Vice Minister of the Interior

The members:

A Vice Minister of Defense

A Vice Minister of Finance

A Vice Minister of Justice

A Vice Minister of Education and Training

A Deputy General Director of the General Department of People�s Police

A Deputy Director of the Vietnam Civil Aviation Department

A Head of a Department under the Ministry of Communications and Transport

The Government Commission on Organization and Personnel shall coordinate with the concerned agencies in proposing the Prime Minister to appoint the Chairman and Vice Chairman of the Committee. The heads of the agencies mentioned in Article 3 of this Decision shall recommend their representatives as members of the Committee.

Article 4.- The standing agency of the National Committee for Traffic Safety shall be placed at the Ministry of Communications and Transport.

The Office of the Committee is located at the Ministry of Communications and Transport and composed of 3 to 5 cadres and specialists who work on a full-time basis and shall be appointed by the Committee�s Chairman.

The Chairman of the Committee shall coordinate with the Minister-Chairman of the Government Commission on Organization and Personnel in promulgating the working regulation, tasks, powers and responsibilities of the Committee�s members, who work on a part-time basis.

Article 5.- The Ministry of the Interior and the Ministry of Communications and Transport shall dissolve the Central Steering Committee for Traffic Safety set up by Decision No.44/QD-LB of May 28, 1991.

Article 6.- This Decision takes effect 15 days after its signing. The earlier provisions contrary to this Decision are now annulled.

Article 7.- The Chairman of the National Committee for Traffic Safety, the heads of the agencies mentioned in Article 3, the ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government and the presidents of the People�s Commi-ttees of the provinces and cities directly under the Central Government shall have to implement this Decision.
