CIRCULAR NoCIRCULAR No. 72/2001/TT-BNN OF JULY 9, 2001 SUPPLEMENTING AND AMENDING A NUMBER OF POINTS IN CIRCULAR No. 62/2001/TT-BNN OF JUNE, 2001 OF THE MINISTRY OR AGRICULTURE AND RURAL DEVELOPMENT GUIDING THE EXPORT AND IMPORT OF GOODS SUBJECT TO THE SPECIALIZED MANAGEMENT BY THE AGRICULTURE SERVICE UNDER THE PRIME MINISTER�S DECISION No. 46/2001/QD-TTg OF APRIL 4, 2001 ON THE MANAGEMENT OF GOODS EXPORT AND IMPORT IN THE 2001-2005 PERIOD
In order to create favorable conditions for goods exporting and/or importing enterprises, the Ministry of Agriculture and Rural Development supplements and amends Points 1.2 and 1.3, Section 1; Point 2.2, Section 2; Point e of Section 5 (Chapter II); Point a, Section 1 and Section 4 (Chapter III) of Circular No.62/2001/TT-BNN of June 5, 2001 guiding the export and import of goods subject to the specialized management by the agriculture service in the 2001-2005 period, as follows:
I. To amend and supplement the following points:
1. Paragraph "b" of Point 1.2 (Section 1, Chapter II), which is amended as follows:
"b/ Products of rare and precious wood of group IIA specified in Decree No.18/HDBT of January 17, 1992 of the Council of Ministers (now the Government) can be exported only in form of fine-art articles and high-class furniture. When exporting them, enterprises shall only have to carry out the procedures with the border-gate customs."
2. Point 1.3 (Section 1, Chapter II), which is amended as follows:
"All products made from timber of all categories (other than those specified in Clauses 1.1 and 1.2) can be exported with unlimited quantity and value. When exporting them, enterprises shall only have to carry out the procedures at the border-gate customs."
3. Paragraph "b" of Point 2.2 (Section 2, Chapter II), which is amended as follows:
By altering F2 to F1 in the 8
th line from the bottom (page 3), the whole phrase shall now be as follows "...products of their offspring of F1 generation downward can be exported,..."4. To add Point e to Section 5 (Chapter II)
"e/ Plant protection drugs and raw materials for the production thereof outside the list of those permitted for use in Vietnam, when needing to be imported for use for foreign investment projects in Vietnam or in service of other special purposes, shall be given the import permits by the Plant Protection Department."
5. Point a, Section 1 (Chapter III), which is amended as follows:
"a/ The Forestry Development Department (No.2 Ngoc Ha street, Ba Dinh district, Ha Noi city; telephone: (04) 8438813): Shall settle problems arising in the course of implementation of Section 1, Chapter II."
6. Section 4 (Chapter III), which is supplemented as follows:
"This Circular replaces Circular No.41/2000/TT-BNN-KH of April 13, 2000 of the Ministry of Agriculture and Rural Development guiding the export and import of goods subject to the specialized management by the agriculture service, and transfers the task of issuing import permits for assay of cultivation plant and livestock breeds and genes, micro-organisms, livestock feeds and fertilizers prescribed in Circulars No.02/NN-KNKL/TT of March 1, 1997 and No.09/NN-KNKL/TT of September 17, 1996 from the Department for Science, Technology and Product Quality to the Department for Agriculture and Forestry Promotion."
II. Implementation effect
1. The contents of Circular No.62/2001/TT-BNN of June 5, 2001 of the Ministry of Agriculture and Rural Development other than the above amended and/or supplemented points shall remain fully effective.
2. This Circular also annuls the following phrases: a) "...permits of the local ranger sub-departments are required" - paragraph (b), Point 1.2, Section 1, Chapter II, line 15 (from the top); b) "and products from planted forests (except for log timber and sawed timber)" (at Point 1.3, Section 1, Chapter II) line 19 (from the top), page 2; c) F2 in line 8 from the bottom, page 3; d) "a/ Local ranger sub-departments: For cases prescribed at Point b, Clause 1.2, Section 1 of Chapter II", page 6 of Circular No.62/2001/TT-BNN of June 5, 2001.
