DECISION No.782-TTg OF OCTOBER 24, 1996, OF THE PRIME MINISTER ON THE ORGANIZATION OF RESEARCH & DEVELOPMENT AGENCIES IN SCIENCE AND TECHNOLOGY

THE PRIME MINISTER

Proceeding from the Law on Organization of the Government of September 30, 1992;

Proceeding from Decision No 324-CT of September 11, 1992, of the Chairman of the Council of Ministers (now the Prime Minister) on re-organizing the system of research & development agencies in technology;

At the proposals of the Minister of Science, Technology and Environment and the Minister-Chairman of the Government Commission on Organization and Personnel,

DECIDES:

Article 1.- To re-organize the existing research & development agencies in science and technology (hereafter referred to as Institutes) of the State as follows:

1. There shall be 41 Institutes directly under the Ministries, ministerial-level Agencies and Agencies attached to the Government.

2. There shall be 6 Institutes directly under State-owned Corporations.

The list of the above Institutes is attached to this Decision.

3. The remaining Institutes which are not yet included in the list shall be up for further consideration for organization in the following forms:

- Institutes directly under Ministries, ministerial-level Agencies, Agencies attached to the Government or State-owned Corporations;

- Institutes operating on a self-accounting basis;

- Institutes converted into independent enterprises or part of enterprises;

- Institutes merged with others or dissolved.

Article 2.-

- With regard to the Institutes directly under Ministries, ministerial-level Agencies and Agencies attached to the Government as stipulated in Clause 1, Article 1, of this Decision, the State shall, depending on their functions, tasks and development needs, continue to supply them with operating expenses and intensive investment for development.

- With regard to the Institutes directly under State-owned Corporations as stipulated in Clause 2, Article 1, of this Decision, the owning Ministries and Corporations shall have the responsibility to manage them and assign them with tasks which are related to the operation of the Corporations. The State shall continue to support them in salary and operating expenses for a period not exceeding 5 years.

- With regard to the Institutes which draw their budget from the State but which do not belong to the said list, the State shall continue to support them in salary for a period not exceeding 5 years.

In administrative terms, the Institutes directly under Ministries, ministerial-level Agencies and Agencies attached to the Government and those directly under State-owned Corporations shall be treated as equals in line with the current regulations of the State.

Article 3.- The Prime Minister shall assign the related branches with the following tasks:

1. The Ministry of Science, Technology and Environment shall coordinate with the Government Commission on Organization and Personnel to issue a circular providing guidance regarding the operating mechanism and the relations among the Scientific and Technological Institutes directly under State-owned Corporations.

2. The Government Commission on Organization and Personnel shall take the initiative to coordinate with the Ministry of Labor, War Invalids and Social Affairs, the Ministry of Science, Technology and Environment and the Ministry of Finance to draft labor policies for the scientific and technological agencies and create conditions for them to rejuvenate and renew their personnel in line with their specific operating conditions in science and technology.

3. The Ministry of Planning and Investment shall take the initiative to coordinate with the Ministry of Science, Technology and Environment and the Ministry of Finance in drafting policies for promoting investment in the material bases of the scientific and technological agencies so as to help them perform the priority tasks of the State; and the policies of making deductions of capital from infrastructural construction and economic projects to carry out the scientific-technological tasks of the projects.

4. The Ministry of Finance shall take the initiative to coordinate with the State Bank of Vietnam, the Ministry of Science, Technology and Environment and the Ministry of Planning and Investment to draft policies concerning taxes and capital lending to scientific and technological organizations, and the policies of encouraging enterprises to invest in science and technology.

5. The Ministry of Science, Technology and Environment shall take the initiative to coordinate with the Government Commission on Organization and Personnel and the Ministry of Finance to draft policies and design support measures for the transition of the scientific and technological agencies which draw their salary from the State Budget to other forms of operation.

The above-said policies and measures have to be drafted and issued within December 1996.

Article 4.- This Decision takes effect from January 1st, 1997.

The Minister of Science, Technology and Environment shall take the initiative to coordinate with the Minister-Chairman of the Government Commission on Organization and Personnel to provide guidance for and inspect the implementation of this Decision and periodically report to the Prime Minister.

The Ministers, the Heads of the ministerial-level Agencies, the Heads of the Agencies attached to the Government, and the Presidents of the provinces and cities directly under the Central Government, have the responsibility to implement this Decision.
