DECISION No. 69/2004/QD-BNN OF DECEMBER 3, 2004 PROMULGATING THE LIST OF PRECIOUS AND RARE PLANT VARIETIES BANNED FROM EXPORT

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to the Government’s Decree No. 86/2003/ND-CP of July 18, 2003 defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the National Assembly Standing Committee’s Ordinance No. 15/2004/PL-UBTVQH11 of March 24, 2004 on Plant Varieties;

Pursuant to the Prime Minister’s Decision No. 46/2001/QD-TTg of April 4, 2001 on the management of goods import and export in the 2001-2005 period;

At the proposal of the Director of the Agriculture Department,

DECIDES:

Article 1.- To issue together with this Decision the list of precious and rare plant varieties banned from export.

Article 2.- The Ministry of Agriculture and Rural Development shall adjust and add new plant varieties to the above-stated list so as to meet production demands in each period.

Article 3.- This Decision takes effect 15 days after its publication in the Official Gazette and replaces the list of precious and rare plant varieties banned from export, issued together with Decision No. 58/2001/QD/BNN/KNKL of May 23, 2001 of the Ministry of Agriculture and Rural Development.

Article 4.- The Director of the Office, the Director of the Agriculture Department, of the Ministry, the directors of the provincial/municipal Agriculture and Rural Development Services, the heads of agencies, Vietnamese as well as foreign organizations and individuals, that are engaged in the production of, and/or trading in, plant varieties in Vietnam shall have to implement this Decision.

LIST OF PRECIOUS AND RARE PLANT VARIETIES BANNED FROM EXPORT

(Issued together with Decision No. 69/2004/QD-BNN of December 3, 2004 of the Minister of Agriculture and Rural Development)

I. Food plant varieties:

- The varieties of Cam sticky rice, Hoa Vang sticky rice, Tu Le sticky rice, Tam rice, Du Huong rice and Nang Thom Cho Dao rice.

- Patroclinal and matroclinal strains of hybrid rice combination.

- Patroclinal and matroclinal strains of hybrid maize combination.

II. Industrial tree and fruit tree varieties (except seeds of export fruits):

1. Tea varieties: Assorted native Shan tea varieties.

2. Orange varieties: The varieties of Bu, Bo Ha, Xa Doai and Duong Canh orange.

3. Grape-fruit varieties: The varieties of Nam Roi, Thanh Tra, Phuc Trach, Doan Hung, Phu Dien and “green-skin” grape-fruits.

4. Longan varieties: The varieties of Hung Yen,  “tieu” cowhide-colored and  yellow-pulp Xuong longan.

5. Litchi varieties: Thanh Ha and Hung Long litchi varieties.

6. Mango varieties: Hoa Loc and Cat Chu mango varieties.

7. Apricot varieties: Huong Tich apricot variety.

8. “Dragon” fruit varieties: Assorted native “dragon” fruit varieties.

9. Durian varieties: “Chin hoa” and Ri-6 durian varieties.
