DECISION No.95/2000/QD-TTg OF AUGUST 15, 2000 ADJUSTING AND SUPPLEMENTING A NUMBER OF CONTENTS OF THE REGULATION ON THE LABELING OF DOMESTICALLY CIRCULATED GOODS AS WELL AS EXPORT AND IMPORT GOODS, ISSUED TOGETHER WITH THE PRIME MINISTER�S DECISION No. 178/1999/QD-TTg OF AUGUST 30, 1999

THE PRIME MINISTER

Pursuant to the Law on Organization of the Government of September 30, 1992;

At the proposal of the Ministry of Trade,

DECIDES:

Article 1.- To amend and supplement a number of articles of the Regulation on the labeling of domestically circulated goods as well as export and import goods, issued together with Decision No. 178/1999/QD-TTg of August 30, 1999 of the Prime Minister as follows:

1. To amend Clause 1, Article 6 as follows:

"Goods appellations are specific names of goods, names already used in the Vietnamese standards of such goods. The names of goods shall be inscribed in letters with the height not shorter than 2 mm (two millimeters)".

2. To amend Clause 4, Article 8 as follows:

"The place for quantity inscription shall be in principal display panel (PDP)".

3. To amend Clause 1, Article 9 as follows:

"Goods being ready-packed foodstuffs, cosmetics, and pharmaceuticals, which are composed of two or more constituents, must have their constituents inscribed on the labels".

4. To amend Clause 8, Article 17 as follows:

"Using goods marks already protected by law without their owners� consents".

5. To amend Clause 1, Article 19 as follows:

"This Regulation takes effects as from January 1st, 2001".

6. To amend Clause 2, Article 19 as follows:

"The branch-managing ministries shall, basing themselves on their respective management functions and the requirements regarding the use and preservation of particular goods items under their charge, have to provide detailed guidance for the labeling of such particular goods items, and at the same time, determine and, after reaching agreement with the Ministry of Trade, publicly announce the particular goods items having special characteristics whose label inscriptions need to be minimized: on contents to be compulsorily inscribed on the labels, constituents� quantity to be inscribed on the labels; major quality criteria which decide the use value and safety; manufacture date, preservation duration and use duration; guidance for goods use and preservation, which shall serve as basis for implementation organization.

Article 2.- This Decision takes effects 15 days after its signing.

Article 3.- The Minister of Trade shall have to guide and urge functional agencies to implement this Decision.

The ministers, the heads of ministerial-level agencies and agencies attached to the Government, the presidents of the People�s Committees of the provinces and centrally-run cities shall have to implement this Decision.
