THE MINISTER OF SCIENCE, TECHNOLOGY AND ENVIRONMENT
Pursuant to the Ordinance on Goods Quality of December 24, 1999;
Pursuant to the Government�s Decree No. 22/CP of May 22, 1993 on the tasks, powers and organizational structure of the Ministry of Science, Technology and Environment;
Pursuant to the Government�s Decree No. 86/CP of December 8, 1995 on the assignment of responsibility of State management over goods quality;
Pursuant to the Government�s Resolution No. 10/2001/NQ-CP of August 31, 2001 on its August regular meeting;
At the proposal of the General Director of Standardization, Measurement and Quality Control,
DECIDES:
Article 1.- Imported crash helmets used by motorbike riders (hereafter abbreviated as imported crash helmets) must be compatible with the Vietnamese standard TCVN 5756-2001 "Safety helmets used for motorbike and moped riders" or the exporting countries� national standards on crash helmets, which are equivalent to the Vietnamese standards.
Article 2.- The imported crash helmets must have their quality inspected and certified as being compatible with TCVN 5756-2001.
The quality inspection of imported crash helmets shall be conducted by one of designated certifying organizations or testing laboratories of the exporting countries.
Article 3.- The above-mentioned quality inspection shall be carried out for each goods lot imported into Vietnam. The imported crash helmets, which have been certified/tested as being compatible with TCVN 5756-2001, must be printed or sealed with stamp or logo of the designated certifying organization or testing laboratory before being imported into Vietnam.
The lots of imported crash helmets fully meet quality conditions for import when all imported crash helmets are printed or sealed with stamp or logo of the designated certifying organization or testing laboratory.
Article 4.- To assign the General Department of Standardization, Measurement and Quality Control to designate the exporting countries� certifying organizations/testing laboratories to conduct the quality inspection of crash helmets.
The General Department of Standardization, Measurement and Quality Control shall announce the list of above-mentioned certifying organizations and testing laboratories to importing enterprises and the concerned State agencies for coordinated management.
Article 5.- This Decision takes effect as from December 1, 2001.
Enterprises, which import crash helmets for motorbike riders, shall have to implement this Decision.
The General Department of Standardization, Measurement and Quality Control shall have to organize and guide the implementation of this Decision.
