Pursuant to the Government�s Decree No.15/CP of March 2, 1993 on the tasks, powers and State management responsibilities of the ministries and ministerial-level agencies;
Pursuant to the Government�s Decree No.178/CP of October 28, 1994 on the tasks, powers and organizational structure of the Finance Ministry;
Pursuant to Clause 3 of Article 4 and Clause 2 of Article 7 of the Government�s Decree No.86/CP of December 8, 1995 on the division of responsibilities for State management over goods quality;
Pursuant to Clauses 6 and 7, Article 2 of the Government�s Decree No.50/CP of June 21, 1994 on the tasks, powers and organizational structure of the Ministry of Aquatic Resources;
Pursuant to the Government�s Decree No.04/1999/ND-CP of January 30, 1999 on charges and fees belonging to the State budget;
After consulting the Ministry of Aquatic Resources and at the proposal of the General Director of Tax,
DECIDES:
Article 1.- To promulgate together with this Decision the Tables of fee levels for aquatic product quality, safety and hygiene control.
Payers of fees for aquatic product quality, safety and hygiene control at the levels prescribed in this Article are domestic and foreign organizations and individuals engaged in the production and trading of aquatic products, that are provided with aquatic product quality, safety and hygiene inspection by the State agencies according to the provisions of law.
Article 2.- The agencies assigned by the State the tasks of State management over aquatic product quality, safety and hygiene as stipulated in the Government�s Decree No.86/CP of December 8, 1995 shall have to organize the fee collection in the process of performing their functions and tasks (referred collectively to as collecting agencies). The agencies collecting fees for aquatic product quality, safety and hygiene control are allowed to temporarily deduct 90% (ninety percent) of the actually collected fee amounts before remitting them to the State budget to cover the expenses for aquatic product quality, safety and hygiene control as well as on fee collection. They shall make registration and declaration for fee remittance into the State budget with the tax agencies of the localities where they are headquartered in strict compliance with the Government�s Decree No.04/1999/ND-CP of January 30, 1999 on charges and fees belonging to the State budget and the Finance Ministry�s Circular No.54/1999/TT-BTC of May 10, 1999 guiding the implementation of the said Decree.
Article 3.- This Decision takes effect 15 days after its signing. To annul the regulations on collection, remittance and management of charges and fees for aquatic product quality, safety and hygiene control, which are contrary to this Decision.
Article 4.- Organizations and individuals that have to pay fees for aquatic product quality, safety and hygiene control; units assigned the task of organizing fee collection and relevant agencies shall have to implement this Decision.
