DECISION No. 12/2003/QD-BTC OF JANUARY 24, 2003 PROMULGATING THE RATES OF CHARGES FOR INSPECTION OF THE TECHNICAL SAFETY AND QUALITY OF EQUIPMENT AND SUPPLIES FALLING UNDER THE SCOPE OF SUPERVISION BY VIETNAM REGISTRY
THE MINISTER OF FINANCE
Pursuant to the Government's Decree No. 86/2002/ND-CP of November 5, 2002 defining the functions, tasks, powers and organizational structure of the ministries and ministerial-level agencies;
Pursuant to the Government's Decree No. 178/CP of October 28, 1994 on the tasks, powers and organizational structure of the Ministry of Finance;
Pursuant to August 28, 2001 Ordinance No. 38/2001/PL-UBTVQH on Charges and Fees; pursuant to the Government's Decree No. 57/2002/ND-CP of June 3, 2002 detailing the implementation of the Ordinance on Charges and Fees;
At the proposals of the Ministry of Communications and Transport in Official Dispatch No. 4283/GTVT-TCKT of November 13, 2002 and of the director of the Enterprise Finance Department,
DECIDES:
Article 1.- To promulgate together with this Decision the Regulation on the rates of charges for inspection of the technical safety and quality of equipment and supplies falling under the scope of supervision by Vietnam Registry, including:
1. Charges for approval of the designs of equipment and supplies.
2. Charges for inspection of the quality of products.
3. Charges for inspection and certification of laboratories, testing stations and establishments manufacturing materials and products.
4. Charges for inspection of the quality of containers.
5. Charges for inspection of the quality of lifting equipment;
6. Charges for inspection of the quality of boilers and pressure equipment.
7. Charges for inspection of equipment and supplies by non-destruction methods.
8. Charges for examination of welders and non-destruction testers.
Article 2.- The charge rates in this Table of Charges are inclusive of value-added tax but exclusive of the fee for the granting of technical safety and quality certificates as well as expenses for accommodation, travel and communication in service of the inspection works conducted at places over 100 km far from the inspection offices.
Article 3.- For inspection works not yet specified in this Table of Charges, the inspection charges shall be calculated according to the inspection duration at the rate of VND 100,000 per hour. The minimum charge per inspection is VND 100,000/inspection.
Article 4.- The charge payers prescribed in this Decision are organizations and individuals for whom the Vietnam Registry offices inspect the quality of their equipment and supplies installed on transport means; inspect the standards of manufacturing establishments, testing stations, laboratories, and other subjects falling under the scope of supervision by Vietnam Registry or at request..
Article 5.- A number of terms used in this Table of Charges are construed as follows:
1. Single products are products manufactured separately for installation and use on transport means and marine projects.
2. Model products are products made for the first time to satisfy the requirements of current technical norms and standards, serving as a basis for permitted mass production.
3. Mass-manufactured products are products manufactured in lots compatible with the approved model products.
4. Charge calculation prices are selling prices for home-made products or buying prices or imported products.
Article 6.- This Decision takes effect as from February 1, 2003 and replaces the Table of Charges for inspection of industrial equipment, supplies and products, prescribed in Decision No. 129/1999/QD-BVGCP of December 16, 1999 of the Government Pricing Committee on the charges for services of registry of sea ships, inland waterway means and industrial products of Vietnamese organizations and individuals, which fall under the scope of registration by Vietnam Registry, and relevant guiding documents.
Article 7.- Organizations and individuals being charge payers, inspection agencies and concerned agencies shall have to implement this Decision.

TABLE OF CHARGES FOR INSPECTION OF THE TECHNICAL SAFETY AND
QUALITY OF EQUIPMENT AND SUPPLIES FALLING UNDER THE SCOPE OF SUPERVISION BY VIETNAM REGISTRY

I. CHARGES FOR APPROVAL OF THE DESIGNS OF EQUIPMENT AND SUPPLIES
1. The charge rates for approval of the designs of equipment or supplies shall be calculated in % of the costs of the designs of equipment or supplies specified in Table 1.

2. The charge rates for approval of the transformation or repair designs shall be equal to 70% of those specified in Table 1.
3. The charge rates for duplication of the approval decisions or approval of modifications of the approved designs shall be equal to 30% of those specified in Table 1.
II. CHARGES FOR INSPECTION OF THE QUALITY OF PRODUCTS
The charge rates for inspection of the quality of products shall be calculated in percentage of the manufacture costs; the prices of product lots or the buying prices of imported products specified in Table 2.

III. CHARGES FOR INSPECTION AND CERTIFICATION OF LABORATORIES, TESTING STATIONS, AND ESTABLISHMENTS MANUFACTURING MATERIALS AND PRODUCTS
The charge rates for inspection and certification of laboratories, testing stations or establishments manufacturing materials and products are specified in Table 3.

IV. CHARGES FOR INSPECTION OF THE QUALITY OF CONTAINERS
1. The charge rates for inspection of the quality of 20-feet containers are specified in Table 4

2. The charge rates for inspection of 40-feet containers shall be the charge rates specified in Table 4 multiplied by co-efficient 1.5.
V. CHARGES FOR INSPECTION OF THE QUALITY OF LIFTING EQUIPMENT
1. The charge rates for first-time and irregular inspections are specified in Table 5.

The charge rates for inspection of the quality of boilers and pressure devices are specified in Table 6.

VII. CHARGES FOR INSPECTION OF THE QUALITY OF EQUIPMENT AND
SUPPLIES BY NON-DESTRUCTION METHODS
1. The charge rates for inspection of the quality of equipment and supplies by non-destruction methods are specified in Table 7.

2. The charge rates for inspection by other non-destruction methods shall be as agreed upon with customers.
VIII. CHARGES FOR EXAMINATION OF WELDERS AND NON-DESTRUCTION TESTERS
The charge rates for examination and granting or extension of welder's or non-destruction tester's certificates are specified in Table 8.
