DECREE No. 174-CP ISSUED ON THE 29th OF SEPTEMBER, 1994, BY THE GOVERNMENT ON THE COMPOSITION OF THE PEOPLE'S COMMITTEE AND THE NUMBER OF VICE PRESIDENTS OF THE PEOPLE'S COMMITTEE AT ALL LEVELS

THE GOVERNMENT

Pursuant to the Law on Organization of the Government on the 30th of September 1992;

Pursuant to Article 47 of the Law on Organization of the People's Council and the People's Committee (amended) passed by the National Assembly on the 21st of June 1994;

At the proposal of the Minister-Chairman of the Government Commission on Organization and Personnel.

DECREES:

Article 1.- The composition of the People's Committee and the number of Vice Presidents of the People's Committee will be set as follows:

A, The People's Committee in Hanoi and Ho Chi Minh City is composed of one President, four Vice Presidents and eight members. They are assigned the following responsibilities:

1. The President of the People's Committee takes overall responsibility and is directly in charge of internal affairs, planning and urban designing (with the assistance of the Chief Architect).

2. One Vice President is in charge of economic affairs, finance, trade, external economic relations, co-operation and investment.

3. One Vice President is in charge of suburban socio-economic affairs.

4. One Vice President is in charge of cultural-social affairs, health, education, sports and physical culture, and social activities.

5. One Vice President is in charge of construction, industry, transport and communication, science and technology, urban public utility projects, and housing.

6. One member in charge of public security affairs.

7. One member is in charge of military affairs.

8. One member is in charge of organizational affairs.

9. One member is in charge of inspection.

10. One member is in charge of planning.

11. One member is in charge of finance.

12. One member is in charge of labor, war invalids and social welfare.

13. One member is in charge of the Office of the People's Committee.

B. The People's Committee in provinces and Haiphong City is composed of one President, three Vice Presidents and five members. They are assigned the following responsibilities:

1. The President takes overall responsibility and is directly in charge of internal affairs, and urban and rural planning.

2. One Vice President is in charge of economic affairs, finance, trade and external economic relations.

3. One Vice President is in charge of cultural-social affairs, health, education, sports and physical culture, and other social activities.

4. One Vice President is in charge of agriculture, forestry, industry, science and technology, natural resources and the environment.

5. One member is in charge of public security affairs.

6. One member is in charge of military affairs.

7. One member is in charge of organizational affairs.

8. One member is in charge of finance or planning.

9. One member is in charge of the Office of the People's Committee.

In provinces with a population of 1.5 million or more, the People's Committee may have additional members to take charge of inspection, and labor, war invalids and social welfare, etc., but the total membership shall not exceed eleven.

C. The People's Committee in districts is composed of one President, two Vice Presidents and six members. They are assigned the following responsibilities:

1. The President takes overall responsibility and is in charge of internal affairs.

2. One Vice President is in charge of economic affairs, planning, finance, agriculture, industry, rural planning and construction.

3. One Vice President is in charge of cultural-social affairs.

4. One member is in charge of public security affairs.

5. One member is in charge of military affairs.

6. One member is in charge of organizational affairs.

7. One member is in charge of inspection.

8. One member is in charge of land administration.

9. One member is in charge of the Office of the People's Committee.

In districts with a population of fewer than 100,000, the People's Committee may have seven members. The above-said duties shall then be divided among the members so as to best suit the function of each.

D. The People's Committee in urban districts and provincial towns and cities is composed of one President, two Vice Presidents and six members, who are assigned the following responsibilities:

1. The President takes overall charge and is directly in charge of internal affairs and urban planning.

2. One Vice President is in charge of economic affairs.

3. One Vice President is in charge of cultural-social affairs.

4. One member is in charge of public security affairs.

5. One member is in charge of military affairs.

6. One member is in charge of organizational affairs.

7. One member is in charge of inspection.

8. One member is in charge of finance.

9. One member is in charge of the Office of the People's Committee.

In urban districts and provincial cities, if special needs arise, the People's Committee may have three Vice Presidents to take charge of economic affairs, cultural-social affairs and urban development. The assignment of the three Vice Presidents shall be decided by the Prime Minister upon the proposal of the President of the People's Committee at provinces and cities directly under the Central Government.

In districts and provincial towns and cities with a population of fewer than 100,000, the People's Committee may have seven members. The above-said duties shall then be divided among the members so as to best suit the function of each.

E. The People's Committee in communes and district townships is composed of one President, one Vice President and five members. They are assigned the following responsibilities:

1. The President takes overall responsibility and is in charge of economic affairs and land administration.

2. The Vice President is in charge of internal and public security affairs.

3. One member is in charge of military affairs.

4. One member is in charge of finance.

5. One member is in charge of cultural-social affairs and information.

6. One member is in charge of transportation, communication and water conservancy.

7. One member is in charge of the Office of the People's Committee.

In communes with a population of fewer than 3,000 and gentle terrain, the People's Committee may have five members. The above-said duties shall then be divided among the five members to best suit the local situation.

F. The People's Committee in urban wards in composed of one President, one Vice President and five members, each with the following duties:

1. The President takes overall responsibility and is in charge of internal affairs, public security and urban development.

2. The Vice President is in charge of cultural-social affairs, health, education, and sports and physical culture.

3. One member is in charge of public security affairs.

4. One member is in charge of military affairs.

5. One member is in charge of finance.

6. One member is in charge of housing and land.

7. One member is in charge of labor, war invalids and social welfare.

Article 2.- The provisions stipulated in Items A, B, C, D, E, F shall apply in a uniform way throughout the country, with due considerations to the percentage of women and people of ethnic minorities in the People's Committee at all levels.

All problems arising in course of the implementation of this Decree shall be reported by the Presidents of the People's Committees in provinces and cities directly under the Central Government to the Prime Minister for solution.

Article 3.- The Government Commission on Organization and Personnel shall monitor, direct and supervise the implementation of this Decree, and shall report in time to the Prime Minister problems arising in the course of the implementation.

Article 4.- This Decree shall apply to the composition of the People's Committee at all levels for the 1994-1999 term. Previous provisions which are contrary to this Decree are now annulled.

The Minister-Chairman of the Government Commission Organization and Personnel, the Cabinet Ministers, the Heads of the Agencies at ministerial level, the Heads of the Agencies attached to the Government, and the Presidents of the People's Committees at all levels, are responsible for the implementation of this Decree.
